Payment is made by bank card via a dematerialised payment system. To optimise the security of transactions, the Site uses a secure online payment system (SSL — Secure Socket Layer), so that all means are implemented to ensure the confidentiality and security of the data transmitted in connection with payment. This online payment system automatically checks the validity of access rights when paying by bank card and encrypts all exchanges to ensure their confidentiality.
A proof of payment is provided to the Customer upon payment and the final invoice will be provided to the Customer upon delivery.
Payments made by the Customer shall be considered definitive only after effective collection of the sums due by the Customer to the Company.
Article 5. Performance of the Order — Delivery of the Products
Delivery consists of the transfer to the Customer of physical possession or control of the Products. The risk of loss and deterioration of the Products is transferred to the Customer upon delivery.
The Products ordered are delivered to the address indicated by the Customer at the time of the Order, according to the delivery method selected.
The Products are delivered in the countries indicated on the website's delivery page. The amount of the delivery charges may vary depending on the country of destination and is indicated on the delivery page.
Delivery times are indicated on the Site at the time the Customer places the Order and may vary depending on the availability of stocks of the ordered Product.
Delivery times are understood in working days and correspond to the average times for preparing and shipping an Order. The delivery time of an Order starts running from the Order Confirmation Date by the Company. The Products are delivered to the Customer no later than the last day of the period indicated on the Order summary.
If the Products have not been delivered to the Customer within this period, for any reason other than the act of a third party, force majeure or the Customer's fault, the latter may rescind the sale by registered letter with acknowledgement of receipt, provided that, by the same means, the Customer has previously enjoined the Company to deliver within a reasonable additional period and the Company has not done so within that period.
In this case, the sale shall be deemed rescinded upon receipt by the Company of the letter informing it of this rescission, unless the Company has performed in the meantime. In the event of rescission of the sale, the sums paid by the Customer shall be returned at the latest within fourteen (14) days following the date of notice of rescission of the Contract, to the exclusion of any indemnity or retention.
Once the Products ordered are entrusted by the Company to the carrier chosen by the Customer, the said Products are under the carrier's responsibility. The Company may under no circumstances be held liable for any delivery delays, loss or theft of parcels attributable to the carrier.
The Customer is required to check the condition of the packaging and the Products delivered upon receipt. It is up to the Customer to make any reservations or complaints he deems necessary, or even to refuse the parcel when it is damaged on delivery.
In the event of non-conformity, loss or damage of the Product(s) ordered due to transport, the Customer undertakes to inform the Company as soon as possible by e-mail at soundfix@buqi.fr. After a period of five (5) working days from the date of receipt of the Product, the delivery is deemed compliant.
Article 6. Right of withdrawal
In accordance with the provisions of Article L. 221-18 of the French Consumer Code, the Consumer Customer has a right of withdrawal allowing him to withdraw from his Order and thus cancel the sale.
The right of withdrawal may be exercised with the Company within a period of fourteen (14) days from the date of receipt of the Products by the Consumer Customer, by notification, by registered letter with acknowledgement of receipt, of the withdrawal form available on the Site or of any unambiguous statement concerning the Consumer Customer's wish to withdraw from his Order.
The exercise of the right of withdrawal does not need to be justified and the Consumer Customer does not have to pay any penalty, for exchange or refund, provided that the Products are returned in perfect condition within fourteen (14) days following notification to the Company of the Consumer Customer's decision to withdraw.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.) enabling them to be put back on the market as new, accompanied by the purchase invoice.
Damaged, soiled or incomplete Products will not be accepted.
In the event of exercise of the right of withdrawal within the aforementioned period, the Company shall refund to the Consumer Customer only the price of his Order and the delivery charges; the return charges shall remain payable by the Consumer Customer.
The refund shall be made no later than fourteen (14) days following cancellation of the Order.
The refund is made using the same means of payment as the one used by the Consumer Customer for the initial transaction.
Article 7. Warranties
7.1. Legal warranty of conformity
In accordance with the provisions of Articles L. 217-3 et seq. of the French Consumer Code, the Consumer Customer benefits from the legal warranty of conformity on the Products for non-conformities existing at the time of delivery and which appear within a period of two (2) years from the said delivery.
The Consumer Customer has a period of five (5) years from the day he became aware or should have become aware of the non-conformity to take action under the warranty. He is exempt from providing proof of the existence of the non-conformity during the first twenty-four (24) months following the date of delivery of the Product.
In the event of non-conformity, the Consumer Customer is entitled, under the conditions of Articles L. 217-8 to L. 217-17 of the French Consumer Code, to have the defective Product brought into conformity by repair or replacement or, failing that, to a price reduction or rescission of the Order.
In order to exercise his rights, the Customer must inform the Company, in writing (e-mail or registered letter with acknowledgement of receipt) attaching photographs, of the existence of the defects or non-conformities within a maximum period of thirty (30) days from the delivery of the Product or their appearance on the Product.
The Company shall correct or have corrected (insofar as possible) the Product(s) deemed defective as soon as possible and at the latest within forty-five (45) days following the Company's observation of the defect or fault.
However, the Customer acknowledges that the Company supplies standard Products, as described in the Catalogue and in the applicable Documentation. Unless otherwise agreed by the Parties, the Products are supplied by the Company as is, without warranty of fitness for the Customer's needs. It is the Customer's responsibility to ensure that the Products ordered are suited to his own needs.
7.2. Warranty against hidden defects
The Customer also benefits, on the Products, from the warranty against hidden defects under Articles 1641 et seq. of the French Civil Code. However, the Company excludes any warranty against hidden defects of which it was unaware.
The Customer has a period of two (2) years from the discovery of the defect to take action under the warranty.
In the event of a hidden defect, the Customer has the choice, under the conditions of Articles 1644 to 1647 of the French Civil Code, between returning the Product concerned and being refunded its price, or keeping the Product concerned and obtaining a reduction in its price.
Article 8. Customer's obligations
The Customer undertakes to use the Products in accordance with their intended purpose, with applicable laws and regulations, with these GTC, and with their applicable Documentation, in particular by respecting any recommendation of the Company concerning their use.

Article 9. Intellectual property

In no event shall the marketing of the Products by the Company entail any transfer of intellectual property rights to the Customer, who is prohibited from exploiting the Product, other than for personal use. The Customer is in particular prohibited from using the Product for commercial purposes.
Article 10. Liability

In its contractual relations with a Professional Customer, without prejudice to any mandatory provision, the Company's liability may only be engaged in the event of proven fault or negligence and is limited to direct damages, to the exclusion of any indirect damage of any nature whatsoever. In the event that the Company's liability is retained, it shall be limited to the higher net amount between (i) the price actually paid by the Professional Customer for the Order; and (ii) one thousand euros (€1,000).
